These terms apply when you use the Smito Solutions ("we", "us") website, our products, or contact us, including through WhatsApp. By using them, you agree to these terms.
Our services
We provide websites (Smito Site Builder), business software (Smito ERP), and related setup and support, together offered as Smito One. What is included in your plan is set out in your order or quote.
Your account
- Keep your login details private. You are responsible for activity under your account.
- Give us accurate information, including business and GST details where needed.
- You may add staff logins, and you are responsible for how they use the service.
Payment
- Plans are billed yearly in advance unless we agree otherwise in writing.
- Prices are in Indian rupees and exclude GST, which is added to your invoice.
- If a payment is overdue, we may pause your service after giving you notice.
- Fees already paid are not refundable, except where the law requires.
Your content and data
Everything you put into Smito — your website content, customers, invoices, and stock — remains yours. You can export it at any time. You give us permission to store and process it only to provide the service to you. Our privacy policy explains how we handle personal information.
Acceptable use
You agree not to use Smito to:
- Break any law, including tax, consumer, and data protection laws.
- Send spam or messages people have not agreed to receive.
- Upload content that is unlawful, harmful, or infringes someone else's rights.
- Interfere with or try to gain unauthorised access to our systems.
WhatsApp messaging
When we message you on WhatsApp, or you use WhatsApp features within Smito, the WhatsApp Business terms and Meta's policies also apply. You must only message customers who have agreed to hear from you, and respect opt-out requests.
Availability and support
We work to keep Smito running at all times, but we cannot promise it will never be interrupted. We will tell you in advance about planned maintenance where we can. Support is included with every plan.
Liability
We provide Smito with reasonable care and skill. We are not responsible for indirect losses, such as lost profit or lost business. Our total liability to you in any year is limited to the fees you paid us in that year.
Ending the service
You can stop using Smito at any time. We may suspend or end your account if you seriously or repeatedly break these terms. Either way, you can export your data for 30 days after your service ends, after which we may delete it.
Changes
We may update these terms. If a change affects you significantly, we will tell you before it takes effect. The date at the top shows the latest version.
Governing law
These terms are governed by the laws of India. Any disputes will be handled by the courts in Chennai, Tamil Nadu.
